City council to consider removal of abandoned property on Main Street

The building has stood vacant in downtown for about a decade, and was unaffectionately nicknamed “The Eyesore of District 4” by former Las Cruces City Councilor Jack Eakman.

At one point the unfinished structure on the southwest corner of Main Street and Amador Avenue was painted, but otherwise no progress or commercial activity has been seen.

Now it looks like the City of Las Cruces may take matters into its own hands.

At its Monday, Aug. 21, regular meeting, the Las Cruces City Council will consider a resolution declaring an abandoned property at 430 S. Main St. as “so ruined, damaged and dilapidated that it constitutes a menace to the public comfort, health, peace or safety and warrants abatement and removal,” according to the resolution the council is expected to discuss and vote on at the meeting.

According to the resolution, the city made the determination after the city Community Development Department and the Code Enforcement Division of the Las Cruces Police Department investigated the condition of the building, and after “multiple calls for service and complaints have been received by Codes Enforcement.”

If the resolution is adopted by the council, it mandates “That John Hoffman, record owner of said building, structure, or premises shall commence removal of same within 10 days after service of a copy of this resolution or within said 10 day period, file written objection to findings herein with the city clerk of the City of Las Cruces, asking for a hearing before the city council,” and “That if there is a failure of compliance with the provision of Section II herein, the City of Las Cruces shall proceed to remove said building, structure, or premises and abate said unsafe condition and the cost thereof shall constitute a lien against such property so removed and against said lot or parcel of land from which such removal be made, all as required and allowed by law.”
